Effects of the judicialization of early childhood education: an analysis from the context of the Municipality of Ribeirão Preto - SP

The present work has the following research problem: what have been the effects of the judicialization of early childhood education in kindergarten in the city of Ribeirão Preto? This research problem was elaborated from an initial exploratory study that identified that the judicialization of early childhood education and the problem of queues for childcare vacancies in the municipality were a constant and assumed contradictory formats and complex relationships over time. Having this questioning and the context that underlies it as initial benchmarks for delimiting the theme, the general objective was to analyze the effects of the judicialization of early childhood education in day care centers from the context of the Municipality of Ribeirão Preto. As to the specific objectives that make up the general achievement, we have: a) to perform a bibliographic review to address the main issues related to the research problem, not only in the field of productions in law, but also in some fields that have a significant interface with the proposed analysis; and b) to identify, systematize and analyze the documents that make up the empirical field and that retain relevance to the problem exposed, as well as connect the latter field with the literature review from the construction of exploratory categories and analysis. For the development of the objectives that were outlined, it is methodologically a qualitative and quantitative empirical research using the techniques of content analysis for the description, inference and interpretation of the selected documents, which are mainly reputed to the organs of the justice system and the public administration of Ribeirão Preto. In terms of theoretical and analytical framework, the research is developed under a critical perspective of law constructed from theoretical perspectives articulated, respectively, in the three initial chapters, which include: a legal-historical framework based, above all, on studies in the educational field; the unveiling of the right to daycare through the articulation of inequalities that mark its access within a critical-feminist and intersectional perspective to law; and, finally, the analysis of judicialization within these mentioned presuppositions and with the connection of perspectives in the field of law, education and public policies. The conclusions of the work consist in the exploratory identification of the effects of the judicialization of early childhood education in the municipality of Ribeirão Preto, as well as its contexts.
