Deaths in prison custody: between accesses and erasures of the imprisoned person and the conditions of life in prison in the sanction management processes in São Paulo

Abstract

The project is part of a research agenda dedicated to understanding deaths in prison custody. Although many studies are dedicated to the study of prisons, few of them focus on the legal dynamics involved in the production of death within these institutions. The general objective of this proposal is to understand the dynamics of the legal-procedural actors involved in the processes of sanction management in the State of São Paulo, regarding how punishment is being experienced and how death is being produced inside prisons. Based on a qualitative approach, the research will adopt as methodological strategies: (i) the document analysis of judicial processes in which there has been the extinction of punishability due to the death of the agent during the fulfillment of the custodial sentence; and (ii) the development of multiple case studies, with semi-structured interviews with the actors involved in the selected processes. It is intended to investigate the factors that guide the prison experience and that may be involved in deaths in custody, dialoguing theoretically with the perspective of necropolitics and modern penal rationality.
