Abstract

This research project BEPE is part of the research process FAPESP 2017/22117-8, entitled "The legal probabilism in cases of domestic violence in Buenos Aires in the late eighteenth century" attached to the FAPESP project "Probabilism and jurisprudence: violence against women in Spanish America (17th and 18th centuries) ", number 18/07071-4. Due to the development of the initial project, we realized the need for a deeper understanding of the History of Women in Buenos Aires. Aires in the 18th century and their social relations, whether in the family, in the Church, at work or other aspects of society. The sources used are not only the 15 processes of violence against women we have at hand, but also the other processes that the advisor abroad and his group at the University of Seville have - more than 200 cases of violence against women, one of the researchers working with Prof. Emilio José Luque Azcona, Dr. Maria Selina Gutierrez Aguilera, specializes in this segment as well, with extensive publication in the field of women in Buenos Aires in the 18th from court proceedings, and will be with us during the investigation. This BEPE will be held at the University of Seville, Spain, under the direction of the Director of the Department of History of America, prof. Emilio José Luque Azcone, along with a team of area teachers. The investigation will take place between January 6 and April 6, 2020. The present study in Brazil is based on the probabilistic theory of law in Iberian colonial America, in an attempt to understand such issues as customs, laws, public opinion, religion, Gender and social class influenced or not the judgments of the processes, using a key reading methodology of moral theology and the analysis of processes by microhistory. It is precisely because of the peculiarities of the relationships of women in marriage, women with their families, women in maternity and women in society that the purpose of this research project abroad is important. It is from this emphasis on women's history that the legal processes that are sources of this project can be most easily studied and analyzed, along with a complementary bibliography and a specific methodology. If custom, religion, popular opinion, gender and social class are essential for the sentence of a process of violence against women in the eighteenth century, in fact, an insight into these categories allows a better exposure and development of the investigation. The whole study is linked to the project "Law and Justice in the Americas", developed at the Center for Iberian Studies at UNIFESP - Federal University of São Paulo (EFLCH - Faculty of Philosophy, Letters and Human Sciences), which intensively investigates social and legal relations. in the Spanish colonies in America.
