Abstract

This research project has as main objective to investigate the contexts of vulnerability and oppression that operate for the possible invalidity of the consent of the woman trafficked for sexual exploitation. In this sense, understanding the phenomenon of globalization and the expansion of capitalism in Latin America, the migration landscape of these women can be linked to the scenario of social vulnerability projected by the intersectionality of patriarchal, capitalist and Eurocentric macrossociological relations that surround the phenomenon of trafficking of people for sexual exploitation. Thus, this phenomenon is linked to a bipolarity between theory and practice in the field of human rights, facing an exclusionary duality that brings several human rights violations, since the object of investigation vulnerability of trafficked women will be related to the debate about the issue of the consent for this type of trafficking in persons. For this scientific investigation, dialectical methodology will be used to rethink the notions of vulnerability associated with human trafficking. In this way, Juridical Sociology, especially the Critical Theory of Human Rights, and the Criminal Sciences will be applied as epistemological elements for the understanding of the condition of vulnerability and oppression in the field of analytical categories of capitalism, gender and Eurocentrism, as well as its relation with the subject of consent.
