While developed countries will take 62 years to double their aging population relative to demographic data for 2015, Brazil will only take 24.3 years to double that indicator. The rapid aging process of the Brazilian population will place the country as the largest in the proportion of people 60 and older in the world as of 2070. The number of aging people worldwide grows along with increased longevity and the generation of new and different social demands that make evident the multidimensionality of this process that provides biopsychosocial transformations and the quality of life of the aging people. Although the elderly population is known to be a large user of public services, this segment still needs to be noticed in its specificity. Population aging consonant with the legislation that guarantees these individuals rights that support this process, sometimes leads to a judicialization in access to the Rights of the Elderly, and in the state of São Paulo, the increase in allegations of violation of the rights of the elderly from 2012 to 2013 has grown 118%. All kinds of violations of the right of the elderly are a form of violence, and can be: criminal, - involves persons who act outside the law; collective-refers to the maintenance of social, cultural, gender, ethnic, and age inequalities that produce misery, hunger, submissiveness and exploitation of people; institutional - occurs within institutions through bureaucratic rules and regulations that hinder or impede people's access to public or private services, also occur in labor relations with precarious conditions and work remuneration .; interpersonal-relationship between people that usually produces moral, physical and psychological damages; self-inflicted violence - suicide or attempts to kill oneself; cultural violence-discrimination and prejudices that are so common and repeated in society, gender and racial violence stand out in this segment. The objective of the study is to collect data from the Public Defender's Office of the County of São Carlos in the period from January to October 2017 to raise the demands for the defense of rights involving the elusive elective person to be attended by categorizing violence, The research is descriptive, exploratory, retrospective, based on documentary study fundamentals through analysis of content, study and categorization, which may lead to the formulation of proposals for improvement and new proposals that meet the needs of this population, thediscovery of the greatest violators of these rights, as well as the articulation of the existing protection network for the elderly.
