Abstract

During our studies at the level of scientific initiation and Master degree, both funded by FAPESP, we analyze the defenses and performances of Pliny the Younger in the senatorial and centumviral courts to understand the political career of this Roman senator. Since our proposal was to examine the actions of this senator in legal proceedings, we found a wide specialized bibliography about the Roman law that deals with the study of the rules and applications of laws. A significant part of this bibliography separates the political and administrative context of legal practice. However, this segmentation was not observed in our documentation. This evidence has awakened us to the relevance of a study of the legal organization, and consequently, to the courts of justice, relating them to the political and administrative context. Considering this, in continuity with our previous studies, this research aims to analyze organizations and jurisdictions of the courts of justice based in the city of Rome, through the Pliny's Letters and Panegyricus, and the works of Tacitus, Dialogue on Oratory, Histories and Annals. We have as hypothesis the existence of an intertwining of political-administrative practices and legal practices during the Principate. Unlike the proposing of the bibliography on the subject, our proposal aims to understand the relationship between the political-administrative and legal going beyond the description of the law and court procedures. Our approach aims to increase knowledge of a context of intense disputes, negotiations and sharing of power between the Senate and Emperors, both regular participants in the legal, political and administrative ambit. From the cataloging of active characters in the processes and social networks in which these individuals were surrounded, the research aims to understand the dynamics between the legal and political-administrative activities between the governments of the Emperors Tiberius (14-37 AD) to Trajan (98-117 AD).
