The obligation to an institutionalized education and recognized as an alienable right, imposes to a person the subscription in a State, which one is operated by force and repression. Such right, therefore, that ensures for all access to school, is both a conquest and concession. At the same time, the punishment in situation to a teenager in fulfillment of socio-educational penalty in a assisted freedom - obligate to study as a requirement to be paid off his legal obligation to the State - is a sine qua non condition in society that operates by the disciplinary authority, since it is the one that adjusts and adapts the bodies orchestrated among themselves, extracting them a higher performance. Based on theoretical writings of Michel Foucault, this research as a master's degree will examine school education as a right and punishment, comprising both as complementary elements, considering as an example the situation of teenager who accomplish socio-educational penalties. In this sense, it will be performed the analysis of documents that explain the relationship of this teenager with the school. (AU)
