Abstract

The project of research aims to analyses how the questions related to the implementing of pregnant prisoners and new mothers rights are being treated by the justice system. Considering that the ordinance holds such issues and standards, we intend to understand, through the analysis of São Paulo court of justice judgments in cases that deal with requests of house arrest by pregnancy and motherhood, as well through interviews with actors of criminal justice system, if the rights of pregnant and new mothers are been implementing by the criminal justice system, as well as such themes are being considered in the arguments of the justice.
