Critical analysis of the Brazilian trade union under the principles of freedom of association ILO

Abstract

Human rights acquired status of universality, ie, applicable to all without distinction only with the promulgation of the Universal Declaration of Human Rights in 1948, whose preamble asserts the eminence of human rights and fundamental freedoms addressed to all peoples and nations. Then start the accession of several countries to the text of the statement, especially to protect the internal constitutional order, seeking consecration of human dignity. The freedoms in the Collective Labour Law, there is the manifestation of the principle of full freedom of association, according to that statement everyone has the right to organize unions and to join to protect their interests, this principle can also be glimpsed in other international credentials, especially in certain conventions of the International Labour Organisation (ILO). Brazil ratified the Universal Declaration of Human Rights and the conventions of the ILO, however, prevails in Brazil applying the model of union organization called unity, which denies the existence of only one trade union organization representing professional or economic category on the same basis territorial. Thus, the theme of research focuses on the relationship of freedom of association with the main models of union organization adopted under the aegis of fundamental human rights, as well as the main problems faced due to not full implementation of the principle and the presentation of measures positive.
