Abstract

The gender concept emerged on modernity, and can be understood as the historic cultural relations between male and female, and then, the definition of the social duties for the men and women. Patriarchate concept is within of the genders, but assumes necessarily a relationship of domination and exploitation of man over woman. This research will use the term patriarchal gender to define the social structure where they sit the state, law and Brazilian penal law. In research dealing with gender and Brazilian criminal law the question of woman as victim has obtained remarkable advances in recent decades, however the analysis of women as criminal remains little explored. In a superficial quantitative analysis you can assign this to the small percentage of the female prison population compared to male, but it is necessary to uncover criminal reactions and qualitatively affect women in the same way or even more intense. From the union of Criminology Criticism and Critical Theory Feminist of the right you can see the criminal coercion of women diverted to ultimately control of that, and identify as a previous control is exercised. For a change in the women's criminalization phenomenon be possible, is necessary to reinterpret the law in other perspective than the androcentric, this perspective it is no longer able to conceive of man as a single model and absolute social being.
