Public policies of attention to the elderly: the judicialization of violated rights

Abstract

The topic on the judicialization of the right to health has now been discussed to a large extent, understood by the Judiciary to act to ensure the necessary assistance to the treatment of human health. This theme in integration with the advancement of longevity gains even more prominence with the Judiciary and it instigates to understand this phenomenon with a view to the aging population. This study will analyze the judicial processes related to the violation of the civil rights of the elderly, in the city of Araraquara, state of São Paulo, highlighting aspects related to the violation of the right to the elderly, and especially to health. The collection will be done at the District Attorney's Office for the Elderly of the city, between the second semester of 2017 and the first semester of 2018. The processes will be from May 2016 to September 2017, following a survey above, and for the extension of data of a similar theme; on the responsibility of the Research Group on Law, City and Aging. The content analysis will be applied, and it is intended to identify with more characterization of the profile of the applicant, relationships about the same with possible prevalences of chronic diseases in old age. It aims to contribute to advancing the understanding of the judicialization in this municipality and to point out possible mechanisms to be adopted in decision-making in this area by the sectors involved, favoring a more adequate and humane elder care, as well as avoiding the growth of new demands with this sector.
