History, law and slavery: the slave laws in the ibero-american old regime

Abstract

Punctually modified version of the dissertation submitted to the Graduate Program in Social History of USP in September 2009 by Waldomiro Lourenço da Silva Junior, the book is devoted to the analysis the formation and procedural setting of the cool tradition in referring to black slavery Castilian and Portuguese America, between the earthy sixteenth century and first half of the eighteenth century, where the prevailing legal culture of the common law. Given the myriad of issues addressed in the legislation, it was made a cut theme in order to make feasible the scope of research in the original molds of a master thesis. The themes chosen, due to its importance in the dynamics of Latin American slavery and manumission were control policies of slave rebellion. The hypothesis was that through the joint between the legislative framework and the concreteness of social practice constituted a mode of production typical of the Iberian slave laws, which collaborate for setting up systems of slavery with specific characteristics indifferent compared to that observed in the French and English Caribbean, for example.
