Children and adolescents subjected to the worst forms of child labor in Santos (SP): reordering the Rights Guarantee System (SGDCA) for prevention and prioritization of social protection rather than criminal liability

Abstract

The aim of this project is to contribute in an innovative way to the reordering of the Rights Guarantee System in its work aimed at children and adolescents (SGDCA) inserted in the worst forms of child labor (TI). The objective is the co-creation of databases, implementation of an Information System and intersectoral articulation, supporting the effectiveness of the preventive and proactive character of the policy in the city of Santos (SP), with the aim of restructuring, in an innovative way, a Public Policy in Execution in the city that guarantees the achievement of the Strategic Axes of the Child Labor Eradication Program, especially: Identification; Social Protection for children and adolescents (CAs) and their Families; and Monitoring of Actions. The modeling of more effective mechanisms for identification, social protection and monitoring becomes even more necessary in view of: 1-) ILO Convention 182 that recognizes drug trafficking as one of the worst forms of child labor; 2-) the recommendation of the IACHR and the CNJ for the adoption of new referral flows, prioritizing referral to social protection services and 3-) the efforts of the National MPT - Coordinfância to promote greater articulation with the Judiciary in facing the worst forms of child labor, including drug trafficking.To this end, it is proposed to: (a) the constitution of an intersectoral Working Group for the co-creation of the Information System and new flows between policies and programs; (b) mapping the trajectories of CAs in IT and in the referenced equipment/services, for the construction and analysis of a database; (c) monitoring cases tracing CA in IT with the actors of the network, raising case studies, feeding training processes and intersectorality; (d) participatory reading of territorial opportunities, with a pilot in the Vila Nova neighborhood; (e) co-creation workshops with the SGDCA; (f) redesign of flows and mechanisms of network articulation, and particularly of the Justice System, regarding cases of CA in IT in order to privilege comprehensive protection and the primacy of non-criminalizing prevention. Active and participatory methodologies will be used, which favor the collective production of knowledge. At the academic level, the aim is to build and share knowledge through research and dissemination in articles, seminars and technical notes, in the following lines: 1 - CA trajectories in child labor and SGDCA equipment; 2 - Analysis of the Individual Care Plan in Socio-educational and the Family Care Plan in PAEFI; 3 - The impact of territorial opportunities on the trajectory of CAs in IT; 4 - Tensions between social protection and criminalization of the worst forms of child labor and the challenges for creating new models of categorization and interinstitutional conflict management. Cebrap, the host institution, will carry out the overall coordination of the project. The Attorney General's Office, through the National Coordination to Combat the Exploitation of Child and Adolescent Labor (Coordinfância), Partner Institution, will support the promotion of public policy in Santos through technical expertise in the reordering of flows of the SGDCA. The other institutions associated with the project are: Santos Social Development Secretariat (SEDS); USP, through the Department of Psychology and the Institute for Advanced Studies (IEA); Unifesp Campus Baixada, through the Department of Health, Education and Society (DSES); UFABC, through the Territorial Justice Laboratory - LABJUTA. The Public Prosecutor's Office (MP) of Santos and the Childhood and Youth Court (VIJ) will act in the deliberation of new SGDCA flows. The VIJ will provide access to judicial processes for modeling the database on adolescents in IT and infractions. All institutions will participate in the Working Group under the Municipal Commission (CM-PETI). (AU)
